Alternatives To Bankruptcy
Depending on your personal circumstances, you may not have to file for bankruptcy. If your creditors realize that unless they work out a different repayment plan, you are going to file, they are usually motivated to reduce the monthly payment and, sometimes the amount outstanding. The alternative (bankruptcy) will likely mean they get nothing or a small fraction of what is owed.
Additionally, it may be that you have a legal defense to some of these debts. We are experienced litigators and will identify which debts can be defeated without bankruptcy. Your creditors will quickly realize they either have no case or that it will be too costly for them to pursue some debts in court.
In some cases, our first step is to contact all of your creditors to propose a repayment plan that pays them something, but is one which you can now afford. We work with you to develop this plan. Understand that it has to be a monthly payment that you can afford, yet still pays each creditor something. It is from this proposed debt-reduction plan that we can now negotiate a reduction of the total amount you owe.
